A businesswoman yesterday narrated to the Eldoret High Court how she was duped into signing a land sale agreement instead of a Sh300,000 loan agreement.
Rose Kimembi said she had approached a shylock for an emergency loan, but had signed the documents in the office of the lender’s lawyer in Eldoret without reading all details in the agreement out of ignorance.
She said the incident has made her lose a one-acre prime plot at Chepkanga trading centre on Eldoret-Iten highway to the shylock, on the grounds that she defaulted to pay the loan which had accumulated to Sh1.2 million.
She further told the judge that she defaulted on the loan repayment because of unavoidable circumstances but the shylock changed the title deed into his name without her knowledge.
Justice Anthony Ombwayo adjourned the case for one month to allow the land registrar to avail all documents in the disputed parcel of land. The case will be heard on March 9.
