Kenya Revenue Authority (KRA)’s plan to collect more than Sh2.7 billion monthly from betting firms has been dealt a blow by the court.
The order issued by Milimani Commercial Courts senior resident magistrate DM Kivuti follows the 2014 successful suit by a Benson Irungu seeking the barring of betting giant SportPesa from deducting and remitting taxes from winnings.
The orders were subsequently overturned on March 29 allowing KRA to continue collecting due taxes from gaming companies. However, Irungu moved to court a fortnight ago and once more, successfully sought orders for the stay of execution of the directive.
KRA legal team has, however, filed submissions seeking vacation of Kivuti’s orders pending hearing of the inter-partes case.
