Two police officers in City Park shooting charged

Two police officers were yesterday charged before the High Court with the murder of a businesswoman at Nairobi’s City Park.

Constables William Kipkorir Chirchir and Godfrey Kirui Kipng’etich who appeared before Justice James Wakiaga pleaded not guilty to murder charges levelled against them by the State.

The duo is accused of shooting dead Janet Wangui Waiyaki on May 20 at City Park, Parklands area in Nairobi county.

Chirchir and Kipngetich were charged after Senior State Prosecutor Catherine Mwaniki informed Justice Wakiaga that mental assessment report indicated that the two were fit to plead to the charges.

The two are alleged to have discharged 15 bullets from their AK-47 rifles, killing Wangui on the spot and injuring Bernard Chege who was with the 41-year-old mother of three.

In addition, the two are said to have been on foot patrol on that fateful day. However, it is not clear why the two were on patrol in an area outside the their jurisdiction.

Through Mwaniki, the State opposed their release on bail and urged the court to grant her  seven days in order to file and serve the defence with a substantive application opposing the same.

However, their lawyer Ham Langat opposed the prosecution’s prayer to have his clients detained saying that the Constitution grants them the right unless there are compelling reasons to deny them bond.

Justice Wakiaga remanded the two at Industrial Area Prison for eight days pending their bail application hearing. 

Wakiaga also ordered that the pre-bail report and victim’s impact statement be tabled in court before June 19 during inter-parties hearing. Court has directed that the main case  be heard from November 20, 21 and 22.
