State given two days to respond to Miguna case

The High Court yesterday granted the State two days to file in their responses in a case in which Miguna Miguna is challenging his deportation and a decision to cancel his citizenship.

Justice Chacha Mwita ordered the government to file and serve their replies to the application on or before February 15. “I have heard the arguments by both parties and what I gather in this application is the question as to whether the respondents were right to deport yet he is said to be a citizen,” said justice Mwita.

The judge said it is important to hear the application for the court to make orders if the respondents complied with the Article of the Constitution while deporting the Miguna Miguna.

Court directions Justice Mwita made the orders after Attorney General through lawyer Charles Mutinda informed the court that he was only served with the petition on Monday at 5pm and urged the court for more time to put in their responses.

“Give us time we file papers, we will abide by the directions of this court we will respond as soon as possible so that the court can make its decision,” said Mutinda.
