Court suspends order on Uhuru’s website

President Uhuru Kenyatta’s Delivery Unit is at liberty to continue running its website advertising government achievements. The Court of Appeal has suspended High Court Judge Chacha Mwita’s decision made on October 19, last year, outlawing the Kenya Government Delivery Portal/website to advertise achievements by the Jubilee administration on its flagship programmes and project undertaken across the country.

Justice Mwita had made declarations that the adverts hailing the four-year achievements were unlawful since they violated Section 14 (2) of the Election Offences Act and fell foul of Articles 10 and 81(e) of the Constitution.

The purported use of public resources to launch and maintain the website was irregular, illegal, and unlawful, the judge had ruled, and prohibited any advertisements in the print and electronic media and banners in public places during the election period.
