The legal battle for a multi million shilling hotel is headed to the supreme court, after a German investor and his wife filed an urgent application at the court of asppeal to be allowed to appeal a decision to dismiss his case, in a battle pitting the couple and two former employees over ownership of the hotel.
The investor Hans Jürgen larger claims that both the high court and the appellate court based their entire ruling on a document presented to court by a lawyer of the two former directors of the hotel.
The hotel salama beach hotel in watamu kilifi county has been at the center of a legal dispute for the past few years, with the German investors maintaining they are the legal owners of the hotel vide a consent agreement by the former owners who owed them money.
In 2015 justice said chitebwe handed the hotel to a Kenyan businessman issack rodrot, who is also facing criminal charges of alleged hacking of emails and his Italian partner stephano ucceli, which led to the appeal by Langer and his wife.
Mr. Langer says he will be pursuing the matter and assured clients and holidaymakers currently at the hotel that the legal battle will not interfere with the running of the hotel, which now runs under the banner of temple point hotel.
He has also instructed his lawyers led by senior counsel to apply for a judicial review of the judgment which he claims was arrived at based on issues not included in pleadings, contrary to the law.
He also took issue with the Kenyan bussineman who he accuses of trying g to invade the hotel using hired goons without following due process.
