Court throws out Budalang’i vote scrutiny plea

The petitioner in the case challenging Budalang’i MP Raphael Wanjala’s (pictured) victory suffered a setback after an application seeking scrutiny and recount of votes was dismissed.

Busia High Court judge Waweru Kiarie said the applicant’s prayers for scrutiny of votes cast on August 8 did not meet the threshold for a review. He said the applicant must satisfy the court that there is a discovery of new and important matter of evidence.

“It has not been demonstrated that such evidence exists,” he said. Kiarie maintained the winner of the case will be guided by the evidence adduced. Ruling is slated for January 30.

Meanwhile, Nyakundi Arani, who is challenging Magwagwa MCA Fred Omayio’s win, said he won the election but the Returning Officer announced Omayio as the winner. He asked a Nyamira court to order the ballot boxes be opened for recount and scrutiny.
