Poll loser wants IEBC witnesses off petition

Kisii County Women’s Rep candidate in the August 8 General Election Dorice Aburi, who is challenging the election of Janet Ong’era has asked the court to bar Independent Electoral and Boundaries Commission (IEBC) witnesses from testifying in the case for allegedly failing to file their responses.

Through lawyer Ombati Omwanza, she told Justice Anthony Ndungu’ that  the commission and the County Returning Officer Sydney Namulungu’s lawyer’s never filed responses filed by a voter Nahashon Akunga and therefore, witnesses cannot take part in the petition without their lawyers responses.

Akunga has sued the Commission, the Returning Officer and Ong’era as first, second and third respondents respectively and wants the court to nullify the election over alleged irregularities.

However, the first and second respondents’  advocate, Elizabeth Karanja told the court that she had filed sworn affidavits for her clients  and urged the court to use them to proceed with the petition, prompting Omwanza to oppose.

Justice Ndung’u will rule on the matter on December 6.
