Pkosing case seeking to compel Nasa to participate in fresh poll thrown out

The High Court has dismissed a case in which Pokot South MP David Pkosing (pictured)sought to compel National Super Alliance flag-bearer Raila Odinga and his running mate Kalonzo Musyoka to participate in fresh presidential poll.

Justice Chacha Mwita ruled that the court did not have the jurisdiction to hear the matter which ought to have been filed at the Supreme Court.

“Issues raised in this petition do not belong to this court and the court cannot extend its jurisdiction,” he said, adding that the parties in the suit had unanimously agreed that no one can be forced to run for an election.

Justice Mwita said the Independent Electoral and Boundaries Commission (IEBC) has done what the Supreme Court directed them to do and if there is a contempt of court by the Nasa principals the Supreme Court can deal with it.
