High Court Judge Stella Mutuku yesterday failed to make final determinations in an appeal filed by Gilgil MP Mathenge Nderitu over a missing file.
She said the file that contained the proceedings of the Political Parties Dispute Tribunal could not be traced, adding that Nderitu was at liberty to file another appeal.
In the appeal, Nderitu claimed that the Tribunal misled itself on the facts of the law. His political rival Martha Wangare was awarded the nomination certificate. Meanwhile, Chief Justice David Maraga yesterday assured aspirants that all disputes related to the controversial nomination exercise will be concluded expeditiously.
He said the Political Parties Disputes Tribunal was working overtime to hear and determine petitions lodged. The High Court is handling 30 appeals arising from the tribunal’s decisions.
